Short answer
This can be answered honestly only as a mechanism, not as a forecast. In Germany, competitor claims require the breached provision to qualify as a market-conduct rule; whether Article 50 does is assessed differently across the legal literature, and we know of no supreme-court ruling on it. So we quote neither amounts nor probabilities.
Why that is
The mechanism at issue: German unfair-competition law lets competitors and certain associations pursue breaches of provisions that are also intended to regulate market conduct (§ 3a UWG), alongside the withholding of material information from consumers (§ 5a UWG). Whether a transparency duty from the AI Act falls into those categories is an open legal question — the commentary we reviewed discusses it without converging. What follows is unglamorous but solid: the risk is neither zero nor quantified. Figures circulating on this are estimates, and we do not repeat them, because we cannot support them. Note also that this route is a German-law question; in other member states the enforcement path looks different.
What this means in practice
The workable response is not to price the risk but to remove the visible occasion for it, and on most websites that is a configuration change in the chat widget. Beyond that, keep a dated record of what was measured on your pages at a given time: disputes turn on the state of a site on a specific day, and nobody remembers that reliably.
Check it on your own page
That is what the check shows: what a competitor sees when they look at your page from the outside. What it does not do is predict whether anyone will act — nobody can, and anyone who claims otherwise is selling fear.
